Hi, this is Danielle Gage, Case Manager at Bright Futures Families Surrogacy, with Ask a Surrogacy Expert. And today our question is: What happens if my surrogate is in breach of contract?

A breach of contract means that one of the parties didn't do what they were supposed to do under the guidelines of the contract. So either they promised to do something or not do something and they didn't follow through. If you feel that a breach of contract has occurred as the intended parent, you need to contact your attorney and and get their advice to find out what your rights and obligations in regards to your specific circumstances are. Breaches of contracts don't really happen that often, and I really hope this was a hypothetical question and this didn't happen to you. Thank you for your question.
