In a surrogacy journey, each party chooses their own independent attorney to review the contract with them. That means the intended parents will have their own attorney, and the surrogate or gestational carrier will have a completely separate attorney representing her. Even though the intended parent should cover the cost of the surrogate's legal representation as part of the overall surrogacy agreement, the surrogate still has full freedom to choose her attorney. This is a very key point. The attorney is there to represent her interest, explain everything in detail, and make sure she feels comfortable with every part of the agreement. And that does go for the intended parent attorney. They also need to feel comfortable and have everything explained to them and representing their interests as well. This independence is not just a preference, it's actually a standard best practice in surrogacy, both ethically and legally.
